The terms and conditions that govern your use of our website and services. Please read these Terms carefully before using the Aspire Health and Wellness website or scheduling any services. By accessing our website, you agree to be bound by these terms.

Acceptance of Terms

By accessing, browsing, or using the Aspire Health and Wellness website (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. Aspire Health and Wellness reserves the right to modify these terms at any time, and your continued use of the Site following any changes constitutes acceptance of the revised terms.

Use of Website

You agree to use this Site only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the Site.

You may not:

Use the Site in any way that violates applicable local, state, national, or international law.
Attempt to gain unauthorized access to any portion of the Site, its servers, or any connected systems.
Use any automated system, including bots, crawlers, or scrapers, without express written permission.

No Doctor-Patient Relationship

Use of this Site does not create a doctor-patient relationship. A doctor-patient relationship is established only when you have been formally accepted as a patient and seen by one of our providers in person in a clinical setting.

Communication through the Site, including contact forms, appointment requests, and email, does not by itself create a doctor-patient relationship. Anything you send us is kept private and handled in line with HIPAA and our Privacy Policy, and your provider will go over your health details with you directly.

First-Visit Guarantee

Your first visit to Aspire Health and Wellness is free. It includes your consultation and examination with a licensed provider and any in-office ED treatment dose your provider recommends during that visit, whether or not you see results. You and your provider review how you responded before you leave. Any ongoing treatment plan is optional, and its cost is explained before anything begins. This section is effective March 10, 2026.

Intellectual Property

All content on this Site is the property of Aspire Health and Wellness or its content providers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any material on the Site without prior written consent, except for personal, non-commercial use.

Limitation of Liability

To the fullest extent permitted by law, Aspire Health and Wellness shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Site.

This includes damages arising from:

Your access to or use of, or inability to access or use, the Site.
Any conduct or content of any third party on the Site.
Any content obtained from the Site.
Unauthorized access, use, or alteration of your transmissions or content.

You agree to indemnify, defend, and hold harmless Aspire Health and Wellness, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses arising out of your use of the Site, violation of these Terms, or violation of any rights of another party.

The Site may contain links to third-party websites that are not owned or controlled by Aspire Health and Wellness. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.

Governing Law

These Terms shall be governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any legal proceedings shall be brought exclusively in the state or federal courts located in Jefferson Parish, Louisiana.

Modifications

Aspire Health and Wellness reserves the right to revise these Terms at any time. Changes are effective immediately when posted. We will update the “Last Updated” date accordingly. Your continued use of the Site constitutes acceptance of changes.

Severability

If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent necessary or severed. The invalidity of any provision shall not affect the remaining provisions.

SMS Terms of Service

These SMS Terms of Service govern the text messaging service provided by Aspire Health and Wellness (“we,” “our,” or “us”). By opting in to text messages from a web form or any other method, you agree to these terms. If you do not agree, please do not opt in.

1. Types of messages you can expect. By providing your mobile number and opting in, you agree to receive SMS messages from Aspire Health and Wellness, including:

Appointment messages. Appointment scheduling, confirmations, and reminders.
Care messages. Replies to questions you send us, post-visit instructions and follow-ups, and lab and treatment notifications.
Account messages. Billing notifications and other notices about your account with us.

2. Message frequency. Message frequency varies. How often you hear from us depends on your appointments, your care, and the questions you ask.

3. Message and data rates. Message and data rates may apply. These rates are set by your mobile carrier, and we are not responsible for any charges your carrier bills you. Please contact your carrier about your messaging plan. Mobile carriers are not liable for delayed or undelivered messages.

4. Opting in. You can opt in by checking the text message box on our contact form, by booking an appointment online, or by texting us at (504) 788-1212. Agreeing to receive text messages is not a condition of any purchase or service.

5. Opting out. To opt out at any time, text STOP to any message we send. You will receive one confirmation, and no further messages will be sent. To opt back in, reply START.
